Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the EndoAI mobile application ("the App") operated by EndoAI ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Nature of the Service

2.1 Wellness Tracking

EndoAI is a wellness tracking application that helps you:

• Log daily symptoms, medications, diet, exercise, and menstrual cycle data
• View patterns and correlations in your logged data
• Generate structured summaries to share with your healthcare provider
• Store medical documents for personal reference

2.2 Not a Medical Device

EndoAI is not a medical device as defined by the Medicines and Healthcare products Regulatory Agency (MHRA). The App does not:

• Diagnose any medical condition
• Provide medical advice or treatment recommendations
• Replace professional medical consultation
• Make clinical decisions on your behalf

AI-generated observations are pattern summaries aligned with NICE NG73 guidelines, not clinical assessments. Always consult a qualified healthcare professional for medical decisions.

2.3 MHRA Compliance

We have designed EndoAI to fall outside the scope of medical device regulation. The App uses language consistent with wellness tracking ("patterns observed", "insights", "observations") and never uses diagnostic language. All AI outputs include appropriate disclaimers.

3. Account Registration

To use EndoAI, you must:

• Be at least 16 years of age
• Provide accurate registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account

You may create only one account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Responsibilities

When using EndoAI, you agree to:

• Use the App only for personal wellness tracking purposes
• Provide accurate symptom and health information
• Not rely on the App as a substitute for professional medical advice
• Seek emergency medical help (call 999) if you experience a medical emergency
• Not reverse-engineer, decompile, or attempt to extract the source code of the App
• Not use the App to harm, harass, or mislead others

5. Subscriptions and Payments

5.1 Free Tier

EndoAI offers a free tier with daily records, core tracking, up to two medications, and up to three Medical Vault documents.

5.2 Premium Subscription

Premium features include Health Intelligence, appointment stories, AI-assisted document summaries, unlimited medication and Medical Vault records, and Doctor Preparation and Pain Diary PDF exports. Premium is available through monthly or annual subscriptions managed via the Apple App Store or Google Play Store.

5.3 Billing and Cancellation

• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• Cancellation takes effect at the end of the current billing period
• Refunds are handled according to Apple App Store or Google Play Store policies
• We do not process payments directly; billing is handled by your platform's app store, while RevenueCat manages subscription status

6. Intellectual Property

All content, features, and functionality of EndoAI — including but not limited to text, graphics, logos, icons, the Aura design system, AI models, and software — are owned by EndoAI and protected by intellectual property laws.

You retain ownership of any personal data and content you submit to the App. By using the App, you grant us a limited licence to process your data solely to provide the service as described in our Privacy Policy.

7. Data and Privacy

Your use of EndoAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:

• Health data is processed based on your explicit consent
• Data is stored on EU-based servers
• You can export or delete your data at any time
• We never sell your personal data

8. Limitation of Liability

To the fullest extent permitted by law:

• EndoAI is provided "as is" without warranties of any kind, whether express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not liable for any health outcomes resulting from use of or reliance on the App

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under English law.

9. Indemnification

You agree to indemnify and hold harmless EndoAI, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may suspend or terminate your access to the App if you:

• Violate these Terms of Service
• Use the App for unlawful purposes
• Engage in behaviour that harms other users or our systems

You may terminate your account at any time by deleting your account through the App settings or by contacting us. Upon termination, your data will be handled as described in our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App and delete your account.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
